Preliminary vs Final Handover: What Is the Difference?
Preliminary handover certifies that the works are complete and starts the defects liability period; final handover follows once that period has passed without defects, releasing the remaining retention and ending the obligations.
Preliminary handover
The contractor requests it in writing once the works are complete; an inspection committee is formed, walks the site and records its observations in a list handed to the contractor. Once the observations are closed, the preliminary handover record is signed with a specific date, and from that date delay damages stop, the defects liability period begins, and part of the retention is released under the contract.
The defects liability period between them
Through the period between the two handovers — a year in most building contracts — the contractor remains responsible for repairing defects arising from workmanship or materials, though not from misuse. Having a response team ready and documenting and closing every report protects the contractor from open-ended claims at the end.
Final handover
When the defects liability period expires, final handover is requested and the works are inspected again to confirm no defects remain. Signing its record releases the balance of the retention, discharges the performance bond and ends the principal obligations — while liability for major structural defects continues as the contract and the law provide.
What to prepare before asking
Most handover delays are caused by documents, not by works: as-built drawings, system testing and commissioning certificates, operation and maintenance manuals, suppliers’ warranty certificates, and training for the owner’s team. Prepare them alongside the finishes, not after them.
Worked example
A school was handed over preliminarily on 12 March after 214 observations were closed, releasing half of the SAR 410,000 retention. During the defects liability period nine reports came in and each was closed within a week, so final handover was granted on time, the balance of the retention was released and the bank guarantee discharged.

Can preliminary handover take place with observations still open?
In practice it happens through a conditional handover, or a partial handover of completed sections, but the principle is to close the observations first. Any conditional handover must state clearly what remains, by when, and what it means for the retention.
Who pays for utilities after preliminary handover?
The principle is that responsibility for operation, consumption and insurance passes to the owner from the date of preliminary handover — a clause worth stating expressly in the contract to avoid a dispute.
Does preliminary handover stop delay damages?
Yes. The date of the preliminary handover record is the completion date against which damages are calculated, which is why it matters that the contractor does not lose a single day in requesting the inspection once the works are ready.
